1. Agreement to Terms

By purchasing and using Brainator ("the Software"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not purchase or use the Software.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Brainator, LLC ("Company," "we," "us," or "our").

2. License Grant

Upon purchase, we grant you a personal, non-exclusive, non-transferable, lifetime license to use Brainator software.

You May:

• Install the Software on multiple devices you personally own
• Generate unlimited worksheets for personal or educational use
• Use the Software for homeschooling, tutoring, or classroom teaching
• Receive all future updates and new features at no additional cost

You May Not:

• Redistribute, sell, rent, lease, or sublicense the Software
• Reverse engineer, decompile, or disassemble the Software
• Remove or alter any proprietary notices or labels
• Use the Software to create competing products or services
• Share your license with other individuals or organizations

3. Payment Terms

Brainator is sold as a one-time payment for lifetime access. There are no recurring subscription fees.

What You Pay For:

• Software License: One-time payment for lifetime access to Brainator
• Free Support: 6 months of email support included
• All Future Updates: Included at no additional charge

What You Don't Pay For:

• OpenAI API Costs: You provide your own OpenAI API key and pay OpenAI directly for AI generation (approximately $0.001 per worksheet)
• Extended Support (Optional): After 6 months, you can optionally purchase extended support for $20/year

4. API Key Usage (BYOK Model)

Brainator uses a "Bring Your Own Key" (BYOK) model. You must provide your own OpenAI API key to generate worksheets.

Your Responsibilities:

• Create and maintain your own OpenAI account
• Secure your API key and keep it confidential
• Pay OpenAI directly for API usage based on your consumption
• Comply with OpenAI's Terms of Service

Our Responsibilities:

• Never store or access your OpenAI API key on our servers
• Keep your API key encrypted locally on your device
• Provide clear instructions for API key setup

Important: We are not responsible for any costs, issues, or disputes related to your OpenAI account or API usage.

5. Refund Policy - 90-Day Power Guarantee

We offer an unconditional 90-day money-back guarantee. If you're not satisfied with Brainator for any reason within 90 days of purchase:

• You receive a full refund
• You keep the software - it's yours forever
• No questions asked - we trust you

6. Saved Payment Methods for Future Offers

During checkout, you may consent to save your payment method for potential one-click special offers after your purchase (such as add-ons, upgrades, or complementary products).

How It Works:

• You will see a checkbox asking for your consent
• Your payment information is securely stored by Stripe (our payment processor)
• We will only charge your saved payment method when you explicitly click "Purchase" on an offer
• You can remove your saved payment method anytime by emailing [email protected]

7. Privacy & Data Security

We take your privacy seriously. Brainator is designed with privacy-first principles:

• Your worksheets and data stay on your computer
• Your OpenAI API key is stored locally and encrypted
• We do not track, collect, or sell your personal data
• Payment processing is handled securely by Stripe

8. Intellectual Property

Brainator, including all software, code, designs, and documentation, is owned by Brainator, LLC and protected by copyright, trademark, and other intellectual property laws.

Ownership of Generated Content:

You own all worksheets, stories, and content you generate using Brainator. You may use, modify, distribute, or sell your generated content without restriction.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Brainator is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Software
• Our total liability is limited to the amount you paid for the Software
• We are not responsible for issues with third-party services (OpenAI, operating systems, etc.)

10. Updates and Modifications

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of Brainator after changes constitutes acceptance of the new Terms.

For significant changes, we will notify you via email.

11. Termination

This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with these Terms.

Upon termination, you must cease all use of the Software and destroy all copies in your possession.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Brainator, LLC is registered, without regard to conflict of law principles.
